This Privacy Policy applies to data collection and privacy practices of Nomad Health, Inc. (“Nomad”, “we”, or “our”) when we collect personal information through your use of the Sites. We are committed to treating the personal and corporate information of our users (“user,” “users,” “you,” or “your”) with respect and sensitivity. This Nomad Privacy Policy (“Privacy Policy”) is part of our Terms of Service (“Terms”). By accessing or using the Sites in any manner, you agree to be bound by the Terms. As one of our Clients, Professionals (each as defined in the Terms) or as a visitor using the Sites or our services, you understand and agree that we collect, use and disclose your Personal Information (as defined below) in accordance with this Privacy Policy.If you have any questions or comments about this Privacy Policy, please submit a request to privacy@nomadhealth.com.
  1. Changes to Our Privacy Policy
    As our services evolve and we perceive the need or desirability of using information collected in other ways, we may from time to time amend this Privacy Policy. We encourage you to check our Sites frequently to see the current Privacy Policy and Terms in effect and any changes that may have been made to them. If we make material changes to this Privacy Policy, we will post a notice of the revised Privacy Policy for a reasonable period of time and the revised effective date on our Sites.
  2. Information We Collect About You
    1. Information You Provide to Us.
      1. Communications.When you contact us through the “Contact Us” link in our Sites, by emailing us, including at support@nomadhealth.com, or through our mobile application, we may collect your name, company name, email address, telephone number and street address along with other information you may choose to submit, as part of the inquiry process.
      2. Account Registration.When you register for a Nomad account as a Client (as defined in the Terms), we collect information from you that may include your name, company name, email address, telephone number, street address, taxpayer and immigration information, payroll, insurance and banking information as well as other information that you submit as part of your profile or job posting.When you register for a Nomad account as a Professional (as defined in the Terms) or submit information as part of your profile or application, we collect information from you that may include your name, email address, telephone number, street address, taxpayer and immigration information, date of birth, education and work history and credentialing information, background check reports, medical license number, information about your license(s), federal Drug Enforcement Administration registration information, employment-related drug test results, immunization records, job preferences (such locations and specialties), application references, timecard information, or other information that you submit. We also collect information that may be considered sensitive personal information including, without limitation, your Social Security number.You may be asked to choose a username, such as your email address, and a password that will be used to access your account. By providing your information to us, you explicitly agree to our collection and use of such information as described in this Privacy Policy.We may also send text messages for marketing and informational purposes, when permissible by law, with your consent.The information you provide us must be accurate and up to date. We may verify or validate the information that you provide us through third parties.
      3. Business Contacts.We may receive contact information (including your name, telephone number, and email address) and/or professional or business-related information (including your business address), through our interactions with you in a business-to-business capacity, such as when your business provides services to us, or when we work together on a project, or when we discuss business opportunities. We may contact you with information about our business dealings, news, and opportunities, and we may use your information in the normal course of our business operations.
      4. Social Media.If you post information on a webpage we establish on a social media platform, we may use the information to respond, to promote our business and services, and otherwise in the normal course of our business operations. We may collect your personal information, such as your social media username, and other personal characteristics that you have made publicly available to us through the webpage we established on the social media platform. Note that the third-party operators of social media websites also receive such information, and their use of your personal information is governed by their own privacy policies.
    2. Information Collected from Other Sources.In relation to your account profile, we may also collect information about you from other publicly available sources, which we may combine with the other information you provide to us.
    3. Information Automatically Collected.We (or our service providers acting on our behalf) may collect information about how you use our Sites or our services. Some information automatically collected may be correlated with your account information. Usage information may include:
      1. Device-specific information (such as your hardware model, operating system version, unique Device (as defined below) identifiers and mobile network information, including phone number. We may associate your Device identifiers or phone number with your Nomad account. For purposes of this Privacy Policy, a “Device” is any computer used to access the Sites, including without limitation a desktop, laptop, mobile phone, tablet, or other consumer electronic device;
      2. Log information recorded when you use our Sites including your Device, its software, and Device identifiers and mobile network information, including phone number. We may associate your Device identifiers or phone number with your Nomad account. This may include:
        1. The Device’s Internet Protocol (“IP”) address;
        2. Identification numbers associated with your Devices;
        3. Device event information such as crashes, system activity and hardware settings;
        4. Locale preferences;
        5. Application activity such as app upload, app download, app installation, app uninstallation, app start, app play duration, app stop, app crashes, app network activity and app resource consumption;
        6. Date and time stamps associated with transactions;
        7. System configuration information;
        8. Metadata concerning your mobile or smartphone apps; and
        9. Other interactions with our Sites; as well as
      3. Geolocation information. When you use a location-enabled Device, we may collect, process and retain information about your actual geolocation if you have so agreed. We may also use various technologies to determine location, such as sensor data from your Device that may, for example, provide information on nearby Wi-Fi access points and cell towers. By using a location-enabled app and turning on this feature, you consent to us processing information about your actual location.
      We may also permit third party service providers to place cookies through our Sites to perform analytic or marketing functions where you are notified of them and you have consented to the usage.
  3. No Use by Children
    The Sites are not designed nor intended to be attractive to use by children under the age of 16. If you are under the age of 16, do not use the Sites, purchase any products, or use any interactive features of the Sites. We do not knowingly or intentionally gather personal information about children who are under the age of 16. If a child under the age of 16 has provided us with personal information, a parent or guardian of that child may contact us to have the information deleted from our records. If you believe that we might have any information from a child under the age of 16, please contact us at privacy@nomadhealth.com. If we learn that we have inadvertently collected the personal information of a child under 16 years old, or equivalent minimum age depending on applicable jurisdiction, we will take steps to delete the information as soon as possible and cease the use of that information in accordance with applicable law.
  4. Use of Information
    Our use of your personal information is subject to the Terms, which include this Privacy Policy. The provisions contained herein supersede all previous notices or statements regarding our privacy practices with respect to the Sites.We may use aggregated data (independent of any personal identifiers) for research and commercial purposes. This information includes what areas users of our Sites visit most frequently and what services they access most often. This information helps us develop Sites that are more useful and accessible to you.We may use your information internally for our general commercial purposes including, among other things, to improve our Sites, our services, and/or to offer our own, our affiliates’ or third-party products and services that we think you may find of interest. We may use your contact information to contact you, to respond to your inquiries or your account, or to provide information about us or our services. You can elect not to receive promotional emails from us either by “unsubscribing” to an email you receive or by contacting us as indicated below .We may also use your information to comply with all applicable legal requirements and to investigate possible fraud or other violations of our Terms (including, without limitation, this Privacy Policy) and/or attempts to harm our Clients, users or visitors. We may also use your information for any other purpose that is disclosed to you at the point of collection of the personal information, for any purpose for which you provide your prior consent, and for any other lawful purpose.
  5. Do-Not-Track Disclosures
    Except as otherwise stated in this Privacy Policy or the Cookie Policy, we currently do not use technology that recognizes a “do-not-track” signal from your web browser.
  6. Disclosing Your Information
    1. Permitted Purposes. We may reveal information about you for our business and commercial purposes as described below. Information may be disclosed:
      1. If you request or authorize it;
      2. To help complete a transaction for you;
      3. To comply with applicable law, rules, regulations, governmental and quasi-governmental requests, court orders or subpoenas, to enforce our Terms or other agreements, and to protect our rights, property or safety or the rights, property or safety of our users or others (e.g., to a consumer reporting agency for fraud protection, etc.);
      4. As part of a purchase, transfer or sale of services or assets (e.g., in the event that substantially all of our assets are acquired by another party, Client and/or user information may be one of the transferred assets);
      5. To our agents, outside vendors and/or service providers to perform functions on our behalf in connection with the Sites, our services, or our other business operations (e.g., analyzing data, providing marketing assistance, providing customer service, processing orders, etc.) or to allow them to market to you;
      6. To Clients as part of our services;
      7. To our affiliates in the normal course of our business operations, for business and commercial purposes such as to communicate with you, and to promote and provide the Sites and our services; in this regard, personal information may be shared with one of our affiliates for use in providing a service to us; and
      8. As otherwise described in this Privacy Policy.
    2. Permitted Disclosures of Professionals’ Information. We may disclose certain personal information of Professionals pursuant to the Healthcare Professional Employment Agreement entered into between such Professionals and Nomad in connection with a placement with a Nomad Client for healthcare staffing needs.
    3. Permitted Disclosure of Aggregate and Other Non-Personal Information. We may disclose your aggregated or otherwise non-personal information, such as usage statistics of our Sites and services to our affiliates and third parties.
  7. Email Communication Choices
    If you do not wish to receive promotional email offers from us in the future, you can “opt out” by contacting us at the address in the “Contact Us” link or by following the “unsubscribe” instructions in any promotional email you receive from us. Please be aware that you are not able to opt out of receiving communications about your account or your transactions with us.
  8. Security
    We utilize reasonable administrative, physical and technical safeguards to protect information against unauthorized access, misuse or disclosure. We endeavor to protect information that you transfer to or Post (as defined in the Terms) on our Sites. Information you send by email is not secure, so please avoid including personal information in any email you send us. No method of electronic transmission or storage is 100% secure. Therefore, we cannot guarantee absolute security of your information.You also play a role in protecting your information. Please safeguard your user name and password and do not share them with others. If we receive instructions using your log-in information, we will consider that you have authorized the instructions. You agree to notify us immediately of any unauthorized use of your account or any other breach of security. We reserve the right to refuse service, terminate accounts, or remove or edit content in our sole discretion.
  9. Privacy Rights
    Certain jurisdictions have specific legal requirements and grant privacy rights with respect to personal information, and we will comply with restrictions and any requests you submit as required by applicable law. For example, you may have the right to: (1) obtain a copy of personal information we maintain about you in a portable format; (2) correct inaccuracies or incompletion in your personal information; or (3) request that personal information be deleted. You may also have the right to not be discriminated against for exercising your privacy rights. If you are a California, Colorado, Connecticut, Utah, or Virginia resident, see Section 10 (Jurisdiction-Specific Notices) below for additional information as to how to exercise rights under the laws of those jurisdictions. If you are located outside those jurisdictions and seek to exercise your rights under the law of another jurisdiction, please contact us by emailing privacy@nomadhealth.com.To help protect your privacy and maintain security, we will take steps to verify your identity before granting you access to the information. We may need to request specific information from you to help us confirm your identity. This is a security measure to ensure that personal information is not disclosed to any person who has no right to receive it. When you make a request, we may also contact you to ask you for further information in relation to your request to speed up our response and require you to follow procedures so that we can verify your identity and the applicable jurisdiction. The verification steps we take may differ depending on your jurisdiction and the nature of the request. Where possible, we will attempt to match the information that you provide in your request to information we already have on file to verify your identity. If we are able to verify your request, we will process it. If we cannot verify your request, we may ask you for additional information to help us do so.We will respond to your request within the time period required by applicable law. However, we may not always be able or required to comply with your request, in whole or in part, and we will notify you in that event.
  10. Jurisdiction-Specific Notices
    1. California Residents. Under the California Consumer Privacy Act, as amended by the California Privacy Rights Act ("CCPA"), California residents have specific rights regarding their personal information. This section describes Californians’ rights and explains how California residents can exercise those rights.

      4. How To Exercise Your California Privacy Rights. You may not be discriminated against for exercising your California privacy rights. You may submit a request to exercise your rights under the CCPA through one of two means:

        2. Call 1-866-525-3171 to submit your request.
        You may also designate an agent to exercise your privacy rights on your behalf. In order to designate an authorized agent to make a request on your behalf, you must provide a valid power of attorney, the requester’s valid government-issued identification, and the authorized agent’s valid government-issued identification.Upon receiving your request, we will confirm receipt of your request by sending you an email confirming receipt. To help protect your privacy and maintain security, we may take steps to verify your identity before granting you access to the information. In some instances, such as a request to delete personal information, we may first separately confirm that you would like for us to in fact delete your personal information before acting on your request.We will aim to respond to your request as soon as reasonably practicable and consistent with any applicable laws. If we require more time, we will inform you of the reason and extension period in writing. If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option. In some cases our ability to uphold these rights for you may depend upon our obligations to process personal information for security, safety, fraud prevention reasons, compliance with regulatory or legal requirements, or because processing is necessary to deliver the services you have requested. Where this is the case, we will inform you of specific details in response to your request.California residents are also entitled to contact us to request information about whether we have disclosed personal information to third parties for the third parties’ direct marketing purposes. Under the California “Shine the Light” law, California residents may opt-out of our disclosure of personal information to third parties for their direct marketing purposes. You may choose to opt-out of the sharing of your personal information with third parties for marketing purposes. To make such a request you should either send an email to privacy@nomadhealth.com with the subject heading “California Privacy Rights” or send a letter addressed to Nomad Health, Inc., Attention: Nomad Legal-Privacy Inquiry, 28 West 44th Street, Suite 600, New York, New York, 10036. In your request, please attest to the fact that you are a California resident and provide a current California address for our response. Please be aware that not all information sharing is covered by the California privacy rights requirements and only information on covered sharing will be included in our response. We reserve our right not to respond to requests submitted to addresses other than the addresses specified in this paragraph.
    2. Colorado and Connecticut Residents.
      1. Information Collected Related to Colorado and Connecticut Residents.Colorado and Connecticut residents have certain rights around Nomad's collection, use, and sharing of their personal information. Nomad engages in “targeted advertising” as that term is defined in the Colorado Privacy Act ("CPA") and the Connecticut Data Privacy Act ("CTDPA"). As to personal information that is automatically collected on our Sites, Nomad may “sell” such information to our marketing partners and analytics providers, as that term is defined under the CPA and the CTDPA. Otherwise, Nomad does not sell personal information. Nomad does not engage in profiling in furtherance of decisions that produce legal or similarly significant effects.Nomad collects various categories of personal information when you use our Sites or services. A more detailed description of the information Nomad collects and how we use it is provided above in Section 2 (Information We Collect About You). Section 6 (Disclosing Your Information) describes the categories of third parties with whom we share personal information, and what information may be shared under different circumstances.     3. Utah and Virginia Residents.
      1. Information Collected Related to Utah and Virginia Residents.Utah and Virginia residents have certain rights around Nomad's collection, use, and sharing of their personal information. As to personal information automatically collected on our Sites, Nomad engages in “targeted advertising” as that term is defined in the Utah Consumer Privacy Act ("UCPA") and the Virginia Consumer Data Protection Act ("VCDPA"), but Nomad does not “sell” your personal information, as such term is defined under the UCPA and the VCDPA. Nomad does not engage in profiling in furtherance of decisions that produce legal or similarly significant effects.Nomad collects various categories of personal information when you use our Sites or services.
